Matthew Davey — Chief Executive Officer and Director
Mr. Davey has over 25 years of experience within the digital media, sports, entertainment, leisure and gaming ecosystems, as well as experience in the public sector. He is an experienced public company executive officer and board member. He has served in executive management positions across the gaming technology arena. Over the course of Mr. Davey’s career, he oversaw more than ten mergers and acquisitions and over $1.2 billion in debt and equity capital raised to support the companies he has led.
Most recently, Mr. Davey was Chief Executive Officer of SG Digital, the Digital Division of Scientific Games Corp. (“Scientific Games”) (Nasdaq: SGMS). SG Digital was established following the purchase by Scientific Games of NYX Gaming Group Limited (“NYX”) (formerly TSXV: NYX), where Mr. Davey served as Chief Executive Officer and Director. The NYX acquisition provided Scientific Games with a vehicle to significantly accelerate the scale and breadth of its existing digital gaming business, including the strategic expansion into sports betting. In his capacity as Chief Executive Officer of NYX, Mr. Davey developed and implemented a corporate strategy that generated strong revenue growth. Mr. Davey shaped company strategy to focus on digital gaming supplier platforms and content that provided various gaming operators with the underlying gaming and sports betting systems for their online gaming business. In 2014, Mr. Davey oversaw the initial public offering of NYX, and his experience in the digital media, sports, entertainment, leisure and gaming industries helped NYX recognize momentum as a public company. After the public offering, from 2014 to 2018, Mr. Davey oversaw seven acquisitions which helped establish NYX as one of the fastest growing global B2B real-money digital gaming and sports betting platforms. These acquisitions included:
• OpenBet: In 2016, NYX completed the $385 million acquisition of OpenBet. This was one of the more complex and transformative acquisitions that Mr. Davey oversaw at NYX. Through securing co-investments from William Hill (LSE: WMH), Sky Betting & Gaming and The Stars Group (formerly Nasdaq: TSG, TSX: TSGI), Mr. Davey was able to get the acquisition from Vitruvian Partners completed successfully, winning the deal against much larger and well capitalized competitors. By combining two established and proven B2B betting and gaming suppliers, NYX was well positioned to provide customers with exciting player-driven solutions across all major product verticals and distribution channels. This allowed NYX to become the leading B2B omni-channel sportsbook platform in the market and the supplier to over 300 gaming operators globally with an extensive library of desktop and mobile game titles, including more than 700 on NYX platforms and more than 2,000 on the OpenBet platform.
• Cryptologic/Chartwell: In 2015, NYX completed the $119 million acquisition of Cryptologic and Chartwell. The acquisition provided NYX with more than 400 titles of additional leading gaming content, a broader customer base, and direct exposure to PokerStars and Intercasino, part of the Gamesys Group (LSE: GYS) — two of the world’s largest online casino offerings.
• OnGame: In 2014, NYX completed the distressed acquisition of OnGame, a premier poker content, platform and service provider. This acquisition provided NYX with one of the best poker products in the industry, access to several regulated jurisdictions, and a valuable talent pool that was instrumental in the growth of NYX. The addition of OnGame further established a path for NYX to continue its growth in both European and U.S. markets.
These acquisitions, together with meaningful organic growth, increased NYX’s revenue from $24 million in 2014 to $184 million annualized in 2017. During that time, Mr. Davey helped build NYX to have over 200 customers in the global gaming industry and a team of 1,000 employees. Mr. Davey’s success at NYX ultimately led to its sale to Scientific Games for $631 million in 2018.
Mr. Davey joined Next Gen Gaming, the predecessor to NYX, in 2000 as the Vice President of Technology, was appointed as Executive Director in 2003 and named Chief Executive Officer in 2005. Prior to that, he was the Senior Consultant for Access Systems, a company that specializes in the provision of back-end software for licensed online casinos. Prior to joining Access, Mr. Davey worked for the Northern Territory Government specializing in matters pertaining to the internet and e-commerce along with roles in the Department of Racing and Gaming. Mr. Davey received a Bachelor of Electrical & Electronic Engineering from Northern Territory University, Australia (also known as Charles Darwin University).
Robin Chhabra — President
Mr. Chhabra has been at the forefront of corporate acquisition activity within the digital gaming landscape for over a decade. His prior experience includes leading corporate strategy, M&A, and business development at two of the global leaders in the digital gaming industry, The Stars Group (“TSG”) and William Hill, and a leading supplier, Inspired Gaming Group (Nasdaq: INSE). Mr. Chhabra served on the Group Executive Committees of each of these companies. From 2017 to May 2020, Mr. Chhabra served as Chief Corporate Development Officer at TSG and, from 2019 to August 2020, he also served as the Chief Executive Officer of Fox Bet, a leading U.S. online gaming business which is the product of a landmark partnership between TSG and FOX Sports, a transaction which he led. During that period, Mr. Chhabra led several transactions which transformed TSG into the largest publicly listed online gambling operator in the world by both revenue and market capitalization and one of the most diversified from a product and geographic perspective with revenues of over $2.5 billion. Mr. Chhabra’s M&A experience is extensive and covers multiple global geographies across the digital gaming value chain and includes the following:
• TSG/Flutter Entertainment Merger: In 2019, Mr. Chhabra led the TSG M&A team that was responsible for TSG’s $12.2 billion merger with Flutter Entertainment (LSE: FLTR). The merger between TSG and Flutter Entertainment is the largest transaction in the digital gaming industry to date. The combination created the largest publicly listed online gaming company with approximately 13 million active customers and leading product offerings, which include sports betting, online casino, fantasy sports and poker. The combined entity includes some of the world’s most iconic digital gaming brands such as Fanduel, Fox Bet, Sky Bet, PaddyPower, Betfair, PokerStars and SportsBet. TSG/Flutter Entertainment is one of the most geographically diverse digital gaming and media companies with leading positions in the United States, United Kingdom, Australia, Ireland, Italy, Spain, Germany and Georgia.
• TSG/Sky Betting and Gaming (“SBG”): In 2018, Mr. Chhabra led the acquisition of SBG from CVC Capital Partners and Sky plc, Europe’s largest media company, in a transaction valued at $4.7 billion. At the time of the acquisition SBG was the largest mobile gambling operator in the United Kingdom and one of the fastest growing of the major operators having doubled its online market share in three years. The acquisition of SBG provided TSG with (a) greater revenue diversification, significantly enhanced expertise and exposure to sports betting just ahead of the judicial overturn of The Professional and Amateur Sports Protection Act of 1992 (PASPA) by the U.S. Supreme Court, (b) a leading position within the United Kingdom, the world’s largest regulated online gaming market, (c) improved products and technology as a result of the addition of SBG’s innovative casino and sports book offerings and a portfolio of popular mobile apps, and (d) expertise in deeply integrating sports betting with leading sports media companies, positioning TSG to create more engaging content, deliver faster growth and decrease customer acquisition costs.
• William Hill (LSE: WMH): At William Hill, from 2010 to 2017, Mr. Chhabra served as Group Director of Strategy and Corporate Development where he led several transactions which contributed to William Hill’s transformation from a land-based gambling operator in the United Kingdom to a leading online-led international business. Mr. Chhabra led William Hill’s entry into the U.S. sports betting and online lottery markets with the acquisition of four businesses, including the simultaneous acquisitions of three U.S. sportsbooks, Cal Neva, American Wagering and Brandywine Bookmaking, in 2011 for an aggregate purchase price of $55 million. These businesses ultimately led William Hill to achieve a leading position in the U.S. sports betting market with a market share of 24% in 2019. Additionally, Mr. Chhabra played a key role in structuring William Hill’s successful joint venture with PlayTech Plc (LSE: PTEC) in 2008. The combined entity created one of the largest online gambling businesses in Europe at the time of its formation and led to William Hill’s buyout of Playtech’s interest for $637 million in 2013. Prior to the transaction, William Hill had struggled in its attempt to establish a strong online gaming platform and a meaningful presence outside the United Kingdom.
Mr. Chhabra has also successfully completed four transactions worth over $1.2 billion in Australia, the world’s second largest regulated online gambling market, and various partnerships in Asia. Additionally, he completed several technology and media related transactions, including William Hill’s investment in NYX, where he worked with Mr. Davey on NYX’s transformational acquisition of OpenBet.
Prior to working in the gaming sector, Mr. Chhabra was an equities analyst and a management consultant. Mr. Chhabra received a Bachelor of Science in Economics from the London School of Economics and Political Science.

WHAT HAS SPORTS, LOTTERY AND CASINO GAMBLING DONE FOR YOU?

When we speak of casino gambling in Australia, we’re usually talking about new live or online pokies, fortuitous wins, or the dreaded affliction of problem gambling. That last topic has been abundantly proliferated by today’s leading politicians and anti-wagering groups. But have you ever ever stopped to ask yourself: What has gambling for you?

There’s a powerful message that gambling is bad. It’s a degenerative activity that causes nothing quite pain and suffering. this is often what anti-pokies campaigns are sputtering in radio and tv ads – that nothing good can come of it.

In reality, much good has come of it. The Australian government didn’t legalize lotteries because it thought the overall public needed a replacement sort of entertainment. It didn’t employ companies like Tabcorp and Tatts to officiate racing and sports betting because legislators had an excessive amount of time on their hands.

What Australia Casino Gambling Does For You
Were you aware that the taxes our government collects from gambling operators are wont to ensure every child is provided a free and honorable education? Did you recognize that Australia uses the cash it collects from lottery sales to send promising athletes to free training camps, where they will excel into professional, tournament-worthy competitors?

While anti-gambling campaigners are busy spitting out problem gambling statistics, the sports, lottery and casino gambling industry is doing little or no to defend itself. likelihood is that , an informed public – one that's made conscious of all the items those taxed wagering dollars do for them – wouldn’t be so easily swayed to side with the Nick Xenophon Team (NXT) of anti-pokies politicians.

Transition To Sustainability Messages
Hannah Harrison, SABMillerHannah Harrison is that the Senior Manager of worldwide Sustainable Development Strategy and Consumer Brands, otherwise referred to as SABMiller. She is of the firm belief that gambling operators should take a page from the book of the beer industry when it involves public messages in sustainability.

“I really think it's interesting once you check out beer brands. you'll not think beer as being a very ethical product, but actually you'll use sustainability messages to bring a beer’s purpose to life,” said Harrison in an interview with nzpokiesonline.com/

“Purpose are some things that's here to remain ,” continued Harrison, especially when it involves things people care about. She explained that brands can improve their sale volume compared to competitors by letting consumers know “they are buying a product that resonates their own personal values…”

Her company played a key role in Uganda creating a sustainable source of income through harvesting Sorghum, a crop that they were ready to become a beer product. Not only did it bring down the value of beer, the govt was compelled to supply harvesters a tax benefit since it had been ready to sell the beer at lower cost. it had been clearly a win-win situation.

How does this have anything to try to to with Australia casino gambling, and therefore the benefits it brings to the people? Harrison explained:

“We were competing not with the prevailing beer but with the elicit alcohol market, attracting people out of the damaging and unregulated, illegal alcohol market. So, we are making beers safer for consumer, creating new revenue for our business and creating money for the govt also , which have increased their tax income for over 50 percent since 2002.”

She went on to explain a huge opportunity for Australia’s casino gambling market to tap into unique product and repair concepts which will inevitably appeal to consumers, just by invoking the facility sustainable messages.

Summary of the 2019 New South Wales State election parties & independents

This is a cross post from a Medium article I wrote about this, I thought it might be interesting as the state election is next week.

The NSW State election is approaching. I decided it was time to find out what each of the parties had to say about their policies. What follows is a brief summary of all the independents and political parties running stand for. I have done by best to provide a good faith reading of these parties and, when relevant, have attempted to clearly notate any editorial comments.

Legislative council parties:

Shooters, Fishers, and Farmers

The Shooters, Fishers, and Farmers are an agrarian, social conservative, and libertarian party whose policy platform is based around ending the government regulation of environmental protections and standards, as well as laws about maintaining native biodiversity which often conflicts with crop plantings. Their main goal is to remove the ability of external forces (governments, courts, or activists) from interfering with the direct commercial goals of land owners as they prize individual property rights which they believe as violated by land reform legislation. Beyond this, they also aim to assist NSW farmers by pushing for drought assistance to combat the current prolonged drought, as well as pushing for further tax cuts aimed at farmers.
Like many other current right-wing groups, they have coalesced behind supporting the end of renewable subsidies and pushing for the building of more coal power stations. Uniquely, they also want to end the interconnection of NSW power to other states in a pseudo-isolationist move. This also means that they oppose many policies about regulating carbon and other pollutants, however as they also support deregulated fishing they are currently signalling their difference from the NSW National Party by wanting to prevent further mass fish deaths in the Murray Darling River.
As part of their right-wing libertarian streak, this consists of ending most government regulation of gun control, whilst also signalling support of ‘tough on crime’ policies and supporting the police and prison guards.

Socialist Alliance

The Socialist Alliance is a traditional socialist political party who are focused providing a more egalitarian society where wealthy individuals and corporations pay aggressively higher taxes to fund re-distributive policies increase the standard of living for lower income peoples. They also want to expand public transport along with taking privatised assets back into public ownership.
They also want to switch to a renewable energy economy and make NSW explicitly anti-racist and a safe haven for refugees. They also believe that our current electoral system is flawed so they wish to introduce a series of electoral reforms to introduce electoral recalls at all levels, and make all levels of government proportional instead of our current mix of representative and proportional government.

Sustainable Australia

Sustainable Australia is focused on what they see as the issue with our current immigration rate. Under their ideological view, having a high immigration is detrimental to Australia as it causes “over-development”, as their website claims, as well as increasing housing costs, and environmental damage. Whilst not explicitly stating it, they appear to be planning on addressing the predicted losses in economic growth from their policies through diversifying the economy. This anti-immigration view covers refugees, as whilst they will allow them to enter the country they believe they should stay around their local region and work be done to improve safety there.
From their policy platform, it appears as if Sustainable Australia wants to limit overseas trade as they have policies on restarting Australian manufacturingjobs, which would assist our economy if we were no longer utilising low cost overseas manufacturing sources. However, they appear to be on-board with the current environmental consensus as they want to transition to a renewable energy economy and want to protect natural lands.

Greens

As one of the minor major parties, most of their policy platform should be somewhat known. It is dominated by their positions on the environment where they want to rapidly transition towards an entirely renewable energy sector, as well as more general policies about reversing environmental pollution of air, land, and water-bodies. Broadly, they are the most prominent socially and economically progressive party in NSW at the moment. However, they are anti-genetically modified crops [Ed. note — this is due to a flawed belief that ‘organic’ food is better than modified, which is not supported by any current research consensus.]
Of note is a current “civil war” within the NSW Greens between the two faction which respectively believe that the Greens should be focused entirely on the environment, and the other who believe that they should be a vehicle for broader democratic socialist policies. However, there has yet to be any noticeable policy arguments (publicly at least) around this, so the factional struggle may be personality based.

Animal Justice Party

The animal justice party is a leftist political organisation based strongly around broadening animal rights and protections. The majority of their policies are to do with ending the killing, or harming of animals in any way. Seem to want to end the use of companion animals (pets) in general but are addressing that bit by bit by limiting how you can adopt animals. They also view population growth as bad for animals and the environment and thus believe we should keep growth at replacement rate, which implies limiting immigration. However, limited policy detail on environmental and climate action policies, broadly says we need a carbon tax and to shift to a renewable power economy.

Advance

Advance is actually a coalition of the Advance Australia Party and the Motoring Enthusiasts. Their policies goals seem to be addressing housing affordability, increasing Sydney’s desirability as a tourist destination, anti-gambling — specifically Barangaroo, desiring the return of the Sydney Monorail — which appears to be driven by their distaste of the Light Rail, pro-electric cars, and “fixing the roads”. Not sure on their political alignment, appear to be a centrist neoliberal party without a social justice platform or any re-distributive policies.

FLUX

Ah, FLUX. FLUX is not a political party in the traditional sense as they have no actual policies in of themselves. They’re a single issue party, which wants to more or less end our Representational Democracy model and replace it with an electronic platform which is a mix of Direct, Representational, and Delegate Democracy where you use ‘an app’ to either directly vote, or nominate someone to vote for you on every piece of legislation in parliament. Legislation, which I assume is also crowd sourced?
[Ed. note — INTERESTING. Meow-Ludo Meow-Meow (real person) who has been a candidate for the Science Party (formerly the Future Party, now running as the James Jansson group) for the last couple of elections has moved to FLUX and is the candidate for Willoughby. You may know him as the dude who put the OPAL chip inside his hand.]

LaboCountry Labor

NSW Labor has a typical modern centre-left policy platform. However, of note is their recent moves to ban single use plastic bags, phase out single use plastics, invest ~$140 million into local recycling projects, and of particular note they claim to want to seek a treaty with the NSW indigenous peopleswhich would replicate similar treaties in Canada and New Zealand. This treaty would cover: recognition of historical wrongs, addressing health and education services, and language rights.
This election, NSW Labor is trying to differentiate themselves from the Liberal Party by emphasising their goals to decrease housing and hospital costs, as well as addressing industrial concerns, such as wage theft and underpayment, as well as providing increased services such as more education facilities and free public transport for children. Another policy difference is their goal to divert the currently allocated funds for stadium redevelopments towards other policies such as renewable powered air conditioning for public schools.
They also wish to legislate 10 days paid domestic violence pay, in addition to investing $158 million towards building new domestic violence and sexual assault courts, increased victim compensation, and increased funding to shelters and advocacy groups.

Liberal/The Nationals

The Liberal/National coalition will be running this campaign based on their record over the last eight years which has constituted increased building of private toll motorways as well as the building of more commuter lines, specifically the light rail and North-West Metro. The party however has been dogged by their more draconian policies around nightlife and music policiesin general. This has been paired with their alleged failures on environmental policies based on the recent spate of mass fish deaths in regional NSW resulting from widespread rorting of water resources by the large commercial cotton farms.

Australian Conservatives

The Australian Conservatives are a factional splinter of the Liberal Party of Australia. They were started by Cory Bernardi who left the party because of his views of the “corrosive left” of the Liberal Party. As such, they are an extremely conservative party. Their policy agenda does not meaningfully move away from orthodox right-wing business politics, and government regulation, as they are libertarian on this front. Their main focus is on ‘white resentment’ politics. This is as their most detailed policy statements deal with ending “gender reassignment” and “political indoctrination”. Their main goals is to realign Australian with their conservative views on what it means to be an Australian, that is to be white and hetero-normative [Ed.]. Broadly they are quite similar to the current Republican party in American in terms of their social and economic views. This party is part of the current wave of populist(whilst not actually being populist as their policies will benefit the 1% primarily) “Western Civilisation” politics based around Nationalism and anti-leftism.

Keep Sydney Open

Keep Sydney Open appear to be a civil libertarian party based around getting the government and its regulation out of the music scene and Sydney nightlife. Their main party agenda is the end the Sydney Lockout laws and the current government’s policies around policing music festivals. Have no really stated political goals outside of this niche beyond some language around a stronger ICAC, and introducing 24 hr public transport. Of note, not actually running a candidate in the Seat of Sydney, where the lockout laws apply.

Liberal Democrats

The Liberal Democrats are an aggressively libertarian party whose only elected member is David Leyonhjelm. The main thrust of this party is promoting “individual liberty”, which is mostly expressed as reducing the ability of governments to enact regulatory legislation, and letting businesses pay less tax. They see effectively no place for the government beyond Defence, and maintaining property rights.
Editorial: the Liberal Democrats use a very American strategy of campaigning, which is “triggering the left”. They’ve also engaged in sexist and racist behaviours in their effort to gain votes from the same constituency of One Nation, Australian Conservatives, and Men’s Rights Activists.

Voluntary Euthanasia Party

The VEP are a single issue party, and that is enacting legislation for voluntary assisted dying. They appear to be a party dedicated to ensuring quality of life up until death through both allowing death to happen on your own terms, increasing palliative care, and improving access to medical cannabis. Beyond that, they claim to be a moderate progressive party and will vote on a case by case basis for all legislation under that framework.

Christian Democratic Party

Otherwise known as the Fred Nile Christian Democratic party. A Christian religious party aiming to “glorify God in government”. Under that framework, are pro-business. Their main niche is ensuring that NSW remains a tacitly Christian state by legislating SRE classes (they’re the ones who made SRE mandatory and that you have to specifically opt out, whilst also making information about that hard to find). This party is extremely conservative about sexuality and gender identity and believe that there is only two gendersand you should only be heterosexual, and thus want to remove the Safe Schools program.

Small Business Party

Another neoliberal business party whose policy focus is on cutting business taxes and regulation, claiming they’re a drain on the economy. This extends to wanting to reduce housing Stamp duties and power prices. Also are anti-immigration as they claiming current NSW immigration is unsustainable and there is no place for them here. [Ed. note — current immigration rate is reason we’re not in a recession at the moment.]

Pauline Hanson’s One Nation

One Nation is the most prevalent of the current Australian mainstream populist (whilst not being popular) ‘white resentment’ political parties. Under the NSW leader Mark Latham — who has a colourful past — the party has taken a specifically Men’s Rights Activist lens as it has explicit platforms on their idea that white men are being repressed in our society.
Outlaw the new Left-wing discrimination against men, boys, Christians and white people, including a ban on discriminatory ‘employment quotas’ and segregationist ‘safe spaces’ — One Nation policy outline
This platform extends towards explicitly racist policies, and removing recognition of transgender people’s rights. These policies manifest themselves through their anti-Islamist rhetoric, claiming that they’ll end “Islamic Radicalisation in schools”, being anti-multiculturalism, and putting forward a policy that only individuals who “pass” a genetic test [Ed. note — which is bullshit] can get Indigenous peoples specific social welfare.
These policies around Indigenous peoples also extend to the Indigenous Land Reform Councils as they claim they’re hoarding billions of dollars which should be taken. Like other prominent white resentment parties, One Nation also supports pro-business reforms such as protectionist policies to maintain monopolies, and cutting their taxes and regulations, as well as being anti-renewable energy and fixated on coal power.

Seniors United Party of Australia (group G)

The Seniors United Party is pushing forward a policy agenda aimed specifically at senior citizens, such as being focused on increased funding and undoing of Liberal/National cuts to superannuation. They also wants oversight and regulation of aged care providers. However, like many other parties running in this election, they are a anti-immigration party and wants to see reduced in overall migration levels.

Monaghan and Monaghan (group H)

This is a husband and wife duo from the northern beaches and the majority of policies appear to be focused on a “not in my backyard (NIMBY)” agenda in regards to the Northern Beaches. However also wants to ban brothels and 24/7 gambling, and very specifically the Woolworths in Mosman.

Jeremy Buckingham Greens splinter group (group L)

Buckingham is a former Greens MLC who left/got kicked out of the party over allegations he committed an act of “sexual violence”* towards a staff member. This was investigated and dropped due to insufficient evidence to substantiate the allegation. Teamed up with Alan Jones to help stop coal seam gas mining
His policies are a little hard to nail down as his content is limited on his website, but based around his previous statements it broadly aligns with the environmental aspects of his former party, the NSW Greens. Of note however, is his desired collaboration with American Tech Baron, Elon Musk, to build a tunnel through the Blue Mountains from Western Sydney to Lithgow.
\allegation was revealed under parliamentary privilege by Newtown MP Jenny Leong. May have been done as part of the current NSW Greens civil war over whether or not they should be a climate action party or a more broadly socialist party.*

James Jansson (group S)

A re-branding of the Science Party as they aren’t registered at State level. Focused on increased transportation, housing density, etc. Seem to be greenish Radical Centrist party with focus on changing regulation and increasing funding without really rocking the boat or doing anything substantial.

Various Independents

Tony Edwards: no clear policy directions stated, with more of a general anti-right perspective.
Ellie Robinson: Anti-corruption platform and wants to address climate change, disability rights, animal justice, indigenous rights.
John Brett: anti-national debt candidate, focus on removing foreign involvement and getting more people back into trade jobs.
Ron Bogan: pro euthanasia, helping out senior citizens, pro-National Energy Guarantee (therefore neoliberal on climate action), focus on the Shire and Western Sydney. Campaign slogan — “put a bogan in parliament”
John Hunter: no information online about him.
Bryn Hutchinson: “progressive independent” — focus on police accountability and a NSW Human Rights Act.
Danny Lim: this is the guy with the billboard hanging around Newtown and the city who’s billboard said “Tony [Abbott] you cvn’t.” From what I can find, running principles of egalitarianism, anti-racism, broadly leftist, pro-renewable energy, investing in public healthcare, removing private healthcare insurance rebate, increasing refugee intake.
Andre Brokman: found his Medium blog — pro-Council amalgamations to increase centralisation and reduce ‘chaos’ in Sydney planning, appears to be a transportation enthusiast. His bio: “Andre Brokman is a full time city planning student and part time uber driver”

I contacted the Victorian Commission for Gambling and Liquor Regulation and they told me that they think lootboxes do constitute gambling under Victorian legislation. Full correspondence within.

I'm not going to show my original message (it's quite long, it also includes my name and student-email, but if people really want to read it I can post it in a comment), but I will post below the response I got from the VCGLR. I'll also note that I'd be quite happy to forward the correspondence to news agencies (on condition that my name/e-mail not be mentioned). Anyway, here's the reply I received:
My name is Jarrod Wolfe and I am the Strategic Analyst for the Compliance Division at VCGLR. I have received your correspondence in regards to gambling functionality (loot boxes) being incorporated into games.
Your research and suppositions on the matter are correct; what occurs with "loot boxes" does constitute gambling by the definition of the Victorian Legislation. Unfortunately where the complexity arises is in jurisdiction and our powers to investigate. Legislation has not moved as quick as the technology; at both State and Federal level we are not necessarily equipped to determine the legality of these practices in lieu of the fact the entities responsible are overseas.
We are currently engaging with interstate and international counter parts to progress wider policy changes and to modernise and inform both Federal and State based legislation. We take on board responses from the community, such as your concerns, to ensure that our actions are reflective of the risks these products pose as well as the community’s expectation. Watching recent Reddit activity certainly indicates the majority of the gaming community is at odds with decisions made by certain companies.
The focus of my concerns currently is on the more predatory aspects related to "pay to win". Skins, skins betting and virtual currencies are certainly a peripheral consideration. However, the idea that (genuine) progression in a game could be reliant on the outcome of a random number generator is at odds with responsible gambling and the objectives of our acts. More importantly the normalisation of gambling vernacular and mechanics targeted at vulnerable persons (minors), is not just morally reprehensible, but is also legally questionable.
In response to our appraisal or understanding of these matters, it is perhaps unfortunate for these companies that gamers have infiltrated most areas of government; be assured that knowledgeable and interested parties are undertaking a large body of work in relation to issues you noted. And if an avenue of investigation or enforcement is found; then we will most definitely pursue it.
Thanks for your detailed enquiry and interest.
I followed up with these questions: What is the legal effect of the responsible entity being based overseas? Does it matter that persons residing in Australia may be making use of those services? What do you think is the biggest barrier to enforcement in relation to this issue currently, and how do you foresee it being overcome? What steps do you think the average citizen/consumer can take towards effecting such change? I also asked if he would mind me sharing the correspondence online. Here is his response:
Thanks for the follow up. Gambling isn’t necessarily “Unauthorised gambling” so there are a lot of variables at play. For perhaps a real world example think of overseas betting agencies. Such as Bet 365 – Australians can and do use this service; yet it is clearly administered and run from the UK. This isn’t illegal. However, if that company set up “shop” in Victoria or started specifically advertising and offering gambling products to Victorians. Then we could investigate and it could be considered a breach of legislation and we would pursue, overseas or not. One of the downfalls is that using overseas based products, Victorian residents do not have us to investigate any complaints or issues they have.
Lootbox and “pay to win” set ups are even more nuanced than just being operated from overseas. Imagine if the legislation was read “strictly” and so you and a couple of friends have a poker game in your garage. You play for real money and sometimes other people join and leave. Now this is obviously gambling, however, is it “unauthorised gambling”? The legislation makes clear determination on some products such as Casino games and the like. But I don’t think parliament ever intended for a Compliance Inspector to kick in your garage door and fine you and your buddies for playing ‘texas hold’em’ in your garage. In order for that to happen we would require far more definitive proof and details and identify profits and purpose and a lot of other factors. This would be the steps we would have to take in order to get close to showing that these video game functions are, strictly speaking, Unauthorised… even then, convincing a magistrate in a prosecution would be a whole other nightmare that would probably cost Victorian tax payers way more money than they would be willing to spend.
But I am a Strategic Analyst, my job is essentially to look at strategies to bring about changes without the necessity of kicking in garage doors and scaring the hell out of a bunch of students. Hence our interest in “loot boxes”. Enforcement is probably not an option, but we can consider working with other agencies to bring about change in other ways. For instance; if these companies want to include significant elements of gambling in their products then perhaps we should work with “The Australian Classification Board” to ensure than any product that does that and monetises it gets an immediate R rating. I could imagine that this would send ripples through the industry and it would support the objectives of the Gambling Legislation to ensure minors are not encouraged to participate in gambling.
As far as affecting change from the consumer perspective. For me, instead of playing certain Star Wars games I was looking forward to, I will be concerting my efforts on collecting EVERY.SINGLE.MOON in Odyssey.
Thanks for your interest. Nothing I am saying is secret; we are working on these complex problems and unfortunately solutions are a lot slower than the technology. The more people that know we are looking the better. The VCGLR want to set the example for dealing with these kind of issues; getting correspondence from you (and others) makes it a lot easier to gauge the feelings of Victorians and lets us know there is genuine interest and concern.
TL;DR - the VCGLR considers lootboxes gambling, but if the entities are based overseas they lack the necessary powers of enforcement.
I was quite surprised to hear this to be honest, as I thought our system would be more like the American inter-State system (where online gambling bodies are bound by the laws of the State that the person using their services is residing in, rather than by the laws of the State where the gambling body is based).
EDIT: I've forwarded the original correspondence e-mail to the BBC, and have forwarded it to Kotaku Australia at their request. I'll update this post with article links if they write stories based on this.

The data on casino trends is going towards online casinos

The web's capability to blur limits and society's approval of gambling establishment gambling and sports wagering eventually clarified the disparities and loopholes of American gambling laws. From the makeshift sports book stalls in Nevada, the majority of sports wagering activities moved operations and made use of the possibilities of the online world in the mid-1990s. At present, there are numerous online video gaming websites accommodating sports wagering and gambling establishment gambling based in nations like Jamaica, Costa Rica, and Ireland.

In spite of overseas-based operations, the lion's share of the earnings and customers of these websites originate from American states. In fact, current research studies reveal that these online gambling establishment gambling and sports wagering websites make more than legal gambling establishments running in Nevada. The earnings of online gambling and wagering websites are approximated at $70 billion for 2005 alone. This is a shocking quantity compared to the reported $2 billion from Nevada gambling establishments. This suffices to topple the three-decade reign of Nevada gambling establishments from the 60's to the early 90's. Thinking about that sports book and gambling establishment websites have actually been running for less than 20 years, they are plainly a risk to the prospering Nevada gambling scene.

For years, Las Vegas is the only location legal for gambling operations. Atlantic City did the same and made gambling establishment gambling legal; the following years saw the expansion of state lottery games, card clubs, video gaming ships, Indian gambling establishments, and off-track wagering hair salons throughout the country. However still, these advancements are insufficient to take on online gambling. The market of online gambling is not even swayed by strong opposition from legal United States gambling establishments. The gambling laws of the United States of America do not assist, too. They differ commonly from the various states. Many states prohibit all kinds of gambling while some make exceptions. Disparities like these make it simple for online operators to discover and utilize loopholes in the law. The American Video gaming Association keeps a protective stand concerning online gambling. The association promotes federal laws on the policy of online gambling. According to them, the uncontrolled nature of the online gambling market is its benefit over conventional gambling establishments; managing it puts both camps on even footing.

However in spite of this stand, some Nevada gambling establishments are following the old stand-by: if you can not beat them, join them. November 1998 saw the start of a brand-new pattern; conventional gambling establishments began obtaining off-shore online gambling establishment gambling business to enhance their earnings. An affiliate of the Hilton Hotels soaked up the Australian sports book slot deposit pulsa. Other Nevada gambling establishments followed and this cycle once again generated a brand-new barrage of disputes.

Contrary to their earlier dislike of the online gambling market, the conventional gambling establishments set their sights greater. They are now pressing the Congress to pass a law that legislates online gambling. This is performed in an effort to lower production expenses; legalization implies that they might now move their operations in the United States. Harrah's and MGM Mirage, the two leading gambling establishments in Nevada and unquestionably owning their own online gambling websites, lead the gambling establishments in asking for the guideline of online video gaming. Plainly, this relocation asking for guideline does not plan to put conventional gambling establishments at par with online websites any longer. The competitors moved in between independent online websites and Nevada casino-owned websites. A transfer to control translates to double revenues for the Nevada gambling establishments.

Whatever comes out of this brand-new advancement in gambling establishment gambling, players are still guaranteed of their gambling repair. Potentially, if the suggested guideline is authorized, there would be more security in wagering online because it is now under United States laws. Like previously, gambling establishment gambling shows itself to be a vibrant and ever-changing market.

Technology and Development of Online Gambling Industry: Choice or Chance?

The long journey from grand casino halls to smartphone mobile apps — let us recount the treacherous path that online gambling ventured and conquered, leading to the technological advancement innovations brought by blockchain technology and crypto-economy.

Image from Shutterstock

Technology and internet in general have changed the way we live our lives drastically. Several technological advancement and widespread internet access enable us to do almost everything digitally. Online gambling industry as a part of the entertainment industry wasn’t spared in the sweeping development brought to us by these technological innovations. Due to these technological advances, online gambling is now one of the most profitable and popular industries since 1990s. It can be found almost everywhere in the world, with a wide range of variety, particularly in the countries of New Zealand and The Netherlands.
Surely, online gambling isn’t as old as the hills, but definitely its history is something worth knowing.

The Birth of Online Gambling

Since the passing of the Free Trade and Processing Act in Antigua and Barbuda in 1994, the online gambling continues to flourish and allowed several companies to be granted license if they wanted to provide online casino services. It was the Caribbean government that first legalized and regulated online gaming. Also, in 1994, a UK company named Microgaming developed and launched its first online casino. It was a momentous event in the development of the online gambling industry and this company still exists today.
CryptoLogic was launched in 1995 and became a significant innovation especially with online money transfers with its fast and safer process. CyptoLogic also launched InterCasino, one of the oldest online casinos that still exists at present. Also, in 1995, Microgaming released its online version of the traditional games such as blackjack, poker, and roulette. NetEnt, a neophyte in the online gambling industry back then, launched its own online games and proved itself to be one of the best and most innovative providers even until today.
From all the widespread development of online gambling throughout the years, online gambling companies all over the world continue to provide eSports, sports betting, novelty betting, in-play betting, bingo, horse racing betting, slots, blackjack, roulette, baccarat, poker in its all forms and other games in the same structure. In short, online gambling became very popular and in 1996, there were 15 gambling websites that became 200 in the following year. In 1998, Planet Poker introduced Texas Hold’Em, making online gambling more accessible to people of the internet.

Legalization: A Bump Down the Road…

Despite the popularity and advancement of online gambling, it reached a low point in 1999 when The Internet Gambling Prohibition Act was approved. The act meant to illegalize any kind of offering of online gambling product to a U.S. citizen. However, this act did not pass and in the same year, a multiplayer online game was introduced so gamers could gamble and chat with each other at the same time.
The struggle continued in year 2000 as the Australian Federal Government passed the Interactive Gambling Moratorium Act banning all unlicensed online casinos existent before May 2000. This happening paved way to several legislations and lawsuits all across the globe. However, that didn’t stop the massive number of online players to continue to grow up to 8 million in year 2001. Online gambling companies’ stocks also continued to rise and reached the value of $4.5 billion in 2002. In 2003, to further regulate online gambling, eCOGRA was established in United Kingdom. eCOGRA was meant to specialize in the certification of online gaming software and systems.
To further the battle on legalization of online gambling industries, the U.S. government pursued national broadcasters and media outlets to ban advertisements for online gambling for they could be illegal. However, Antigua claimed that this could be a violation of the free trade agreement signed in 1994. These seemingly never ending hindrances in online gambling didn’t stop its spread around the world. In September 2006, there were approximately 2,600 online casinos all across the globe.

What the Future Holds

The effects of technological advancement in our lives is truly undeniable. In the world of online gambling, technological innovation didn’t only make it easy and convenient but it paved the way for its progress and popularity it possess. Despite several acts and positive laws to make online gambling safer, many aspects of it are starting to change.
With more positive laws and regulations leaning towards online gambling, Juniper Research estimated that online gambling market will outstretch up to $1 trillion in 2021, citing mobile phones as a major factor in this development.
Surely, these technological advances is just a start of what could be unimaginable several years ago, especially in the world of online gambling. We could probably expect a more realistic and high-quality games enabled by VR technologies and solid security. Moreover, we could also expect a worldwide span of its legalization so as to take online gambling to new levels.

The Next Generation of Online Gambling

Since the invention of Bitcoin in 2008, the nascent blockchain technology has opened the doors to a truly decentralized online ecosystem and it has found its way into countless industries and real-world economies. The uncontested decentralization, transparency and security brought by cryptography and P2P connections bring new solutions into industries that the traditional real-world systems could not resolve.
With this in mind, Faireum wishes to bring these solutions into the online gambling world in order to give players and proprietors alike a fair and value-for-value experience with transparent game logic, a transformed and just business model, and open-source DApp development kits. Investors and coin holders alike can also partake in the ecosystem despite not having participated in online gambling itself with this perfect amalgamation of crypto and online gambling, making gambling more than just a game of chance, but also an opportunity of choice… click here to learn more about this game-changing technology.

Scott Davies wins record prize at 2014 WSOP Asia-Pacific Main Event

The final event at the 2014 WSOP Asia-Pacific series concluded, just a couple of days after a winner was crowned in the highrollers tournament. The main event attracted a total of 329 players, with each of them paying $10,000 to participate, so the prize pool exceeded AU$3 million. The interest for this tournament was tremendous and attracted players from all over the world, including American Scott Davies. With the legislation in the United States still denying players the chance to compete over the Internet. Davies spent most of the time in Canada. There are many professionals who cross the border when they want to play poker online, while waiting for more states to pass favorable bills. There is no shortage of interested poker rooms when it comes to expanding to the United States and among those planning such an expansion is Bet365. For the time being, only New Jersey, Nevada and Delaware allow state residents to play poker over the Internet, but Texas, California and Illinois legislators are also contemplating such laws. Meanwhile poker players have to look elsewhere for entertainment and winning opportunities, with the 2014 WSOP Asia-Pacific Main Event being a shining example. Given the fact that the buy-in was a staggering AU$10,000, only poker professionals could afford to travel all the way to Melbourne to participate. The vast majority of players were locals, but even so just one Australian made the final table and he was also the first to be sent to the rail. Once Ang Italiano was eliminated in the sixth place and claimed $118,000, three Americans, one Englishman and one player from Taiwan were left in the race. The two Americans were sent home shortly after and by this time Scott Davies was clearly in command and had an advantage over his peers when three handed play began. No deal was reached and despite his best efforts, Henry Wang from Taiwan was eliminated in third, leaving Jack Salter and Scott Davies to play for the ultimate trophy. The heads up didn't last too long and the Englishman committed his stack with the slightly weaker hand, which didn't improve. He still took home more than half a million, while the spoils went to the winner who won$850k and the coveted Golden bracelet. This is how the final standings looked like at the end of the 2014 WSOP Asia-Pacific Main Event: 1 Scott Davies USA $850,1362 Jack Salter England $516,9603 Henry Wang Taiwan $343,8054 Kyle Montgomery USA $231,2875 Frank Kassela USA $164,0896 Ang Italiano Australia $118,769

William Hill profits take a dive in Q1

Online casinos, poker rooms and bookmakers as well as their land-based counterparts, have one thing in common: the house always wins. They base their business model on a simple and very effective principle, that players will eventually lose more than they win. Downswings are inevitable in any line of work and bookmakers make no exception, not even prominent ones such as William Hill. The best proof that nobody is immune to variation in this highly competitive environment was provided by the Q1 results, recently released by William Hill. The company operates mostly as a bookmaker, although it has its own online gambling division and even poker rooms. The numbers posted are about the bookmakers operating profit, which fell 14% in the first quarter, mostly due to the fact that favorites met and exceeded expectations. For two consecutive weeks in April, the company suffered a significant loss of as much as 25% at retail level, while over the Internet the downswing was of only 6%. Overall the numbers were contradictory, with over-the-counter turnover rising by 3%, yet to win margins fell by the same ratio. Add to this the fact that one year from now, the 25% duty on fixed odds betting terminals will be imposed, and it is easy to understand why William Hill and other bookmakers are overly concerned. If their estimations are correct then the company will lose in excess of £23 million and they will have to fire more than 400 employees. The prognosis is probably pessimistic, as William Hill tries to draw attention that the legislators are going a step too far and that the new laws might backfire. It is unlikely for major changes to be made to the upcoming regulations, so online casinos, poker rooms and bookmakers alike should close ranks and prepare for a setback. There are also some good news coming from the online gaming, with the revenue increasing by double digit amounts. Arguably the biggest profits were made in online casinos and the mobile divisions were by far the most prosperous, completely offsetting the drop in poker and bingo. William Hill is one of the top bookmakers in the United Kingdom but they are well represented abroad and their Australian operations are also on the rise. As a result of acquiring Sportingbet, Tom Waterhouse and Centerbet their net revenue in Australia grew by as much as 500%. In the great scheme of things, this doesn't represent as much as it seems, but in conjunction with US operations and phone wagering, they led to better than expected operating profit. This is why the dwindling Q1 profits are not expected to have a significant impact and William Hill will continue its operations unabated.

Crown Resorts extends license until 2050

One of the most important poker tournaments in the southern hemisphere is the Aussie millions, a tournament that takes place every year in January or February. For two weeks, Melbourne becomes the hotspot for poker enthusiasts and professionals alike, with thousands of players flocking to Australia. Crown Resorts is the company behind this major event and it is the Crown Melbourne casino that acts as a gracious host for all these prominent players. It came as no surprise that the Australian casino operator has been granted a 17 year extension on its license, all the way to 2050. Some might find it strange that the casino giant was so concerned about expanding the license, which was set to expire in 2033. In this line of work, it is essential to be able to make long-term predictions and that's why the operator was adamant in its efforts to get the license extended for as long as possible. Poker players represent only the tip of the iceberg, because Crown Melbourne casino also serves other categories of gamblers. They will rejoice knowing that an additional 128 extra video poker machines have been added, in addition to the 2500 machines already installed. Furthermore, the commissions charged by the casino will be reduced by 2%, which is great news for those who spend a lot of time playing. VIP gamblers represent the most important category of players and the fact that Crown Melbourne managed to pursue legislators to repel the super tax on international and interstate VIP gamblers is celebrated as excellent news. Until recently, the casino had to impose this tax, which had a deterring effect on the elite players who looked for action elsewhere. On one hand, the gambling operator won a big victory by extending its license to 2050, but rumors state that the plan was to have the license extended all the way to 2092. As far as the authorities are concerned, the fact that Crown will be paying $250 million up front and will match this amount over the next 20 years is more than satisfying. At the time of writing, the casino operator is the biggest employer in the state and the forecast is optimistic, with more than 10,000 people expected to work for them by 2020. Online casinos are still interested in establishing a beachhead in Australia and Victoria in particular, with Coral Casino being one of them. More competition would benefit the players, because the operators would be compelled to offer better terms and diversify their offer. Existing players are fiercely defending their territory, so only time will tell whether other companies will be allowed to operate statewide.

Stuck in dead-end, frustrating, low-paying marketing position. What skills should I be developing?

I started working at my current job in early 2016 as a digital marketer - straight out of college, still bouncing marketing theory around in my head.
When I arrived on my first day, I was asked if I'm in any way opposed to online gaming... And the HR lady didn't mean Counter Strike or Halo. Turns out that I was the newbie in a "marketing" firm that runs a slew of online casinos offshore, and just about the only marketing I was to be involved with was Black Hat.
Now, I was excited at first - I always supported the bad guys in movies. But the fact that this kind of product is barred from advertising on almost every platform and in almost every country makes my job so frustrating. In the past 18 months I've probably been running campaigns for about 2 months in total - the rest of the time has been spent doing admin for other people, and setting up fake advertising accounts that last for a week or two at best. On top of this, the salary is about 1/4 of what local Digital Marketers earn at other companies... We get told that our salaries are worked out by looking at similar roles in the same industry, and because it's Casino, only the higher-ups get salaries they can actually live on (Nepotism is RIFE where I work...). Due to the generally low standard of work that I encounter there, I suspect that the majority of the people who work there are not there because of their experience and/or know-how, but they're there because they're cheap to employ and can more or less do the job at hand.
On top of this, our business is having to pull out of Australia due to new legislation that's being passed, and the Australian market is precisely 50% of our market, which means that retrenchments are around the corner.
Therefore, I would like to know what skills I can develop in order to eventually get into a "real" marketing position where I can actually grow as a marketer as well as start earning a salary that'll allow me to move out of my mother's house. I turn 26 very soon, and need to get on with my life.
Skills I've been developing:
HTML (very basic), Facebook Advertising, Financial Reporting, Copy writing, Black Hat Marketing, Content Marketing (Clickbait), App Store Optimization.
PS. Apologies if I broke any rules
EDIT: I must add that this company maintains a squeaky-clean image on the outside, but inside it is like something out of a movie with Kevin Spacey. Our keystrokes and monitor screens are always monitored at work, and our spoken conversations are also listened in on as well. The latter I know about because I was once disciplined for badmouthing the company when the only other person in the room was the guy who was being disciplined in the room with me, and another friend told me (using written notes) that he had been called into the execs' offices to listen to a recording of my voice to identify me. It's fucked up.
